 Post subject: is there a 3 year rule thats a federal regulation

I was curious. I had thought somewhere I read this or heard it. I have a friend that their mother is in an assisted facitlity and receiving a level of care. She is in the state of Indiana, and has lived in this facility for about 5 years. Now she is out of money, and the kids are thinking of looking at medicaid. Is there some federal regulation out there that is someone has been in an assisted living for over 4 years and now has spent all of her assets. Can they kick her out if she goes on Medicaid. I would appreciate an immediate response to this. Thank you

Dear InsuranceProvider,

If the assisted-living facility is not Medicaid-approved (and most aren't), I don't see how she could stay in that facility and expect Medicaid to pay for the care.

Most assisted living facilities are private pay and do not have to accept or keep any person without the cash (or the insurance) to pay the bill.

Have your friend find out if the facility is Medicaid-approved. The administrator of the facility will be able to provide that information. If it is Medicaid-approved, then they probably have to keep her as a resident (but she would probably have to move to a semi-private room and Medicaid would probably NOT cover the room and board expenses, just the portion of the cost that is attributable to 'care').

If it is not Medicaid-approved, then your friend will either have to start to pay for his mom's care or move her to a Medicaid-approved facility.

Most assisted living facilities do NOT accept Medicaid as a form of payment.

The bottom line is, relying on Medicaid, in most states, means that you severely limit your care options.
